The office
A public office
A German notary is an independent holder of a public office. He owes the same duty to every party of a transaction: impartiality and confidentiality. What the notary does is determined by law.
Dr. Manfred Schaal took over the office of notary in Randerath in October 2010. Since October 2015 the notary has been based in the completely redesigned former rectory on Feldstraße. The entrance is barrier-free.
- Notarisation
- The notary draws up public deeds recording legal transactions and declarations: purchase agreements, wills, powers of attorney, articles of association. Every notarisation is preceded by an examination of the facts and instruction on the legal consequences.
- Certification
- The notary confirms the authenticity of signatures and the conformity of copies with the original, for instance for the land register, the commercial register or authorities abroad.
- Impartial guidance
- The notary advises all parties equally, explains the consequences of a transaction and puts the intentions of the parties into a legally sound form.
Fields of practice
Fields of practice
The notary carries out notarisations and certifications in all areas of notarial work. Four fields account for the largest part of it.
-
Real estate
Including Purchase agreement, transfer, land charge, heritable building right, declaration of division
The purchase and transfer of real property require notarisation. The notary prepares the draft contract, explains it to all parties and accompanies the execution through to registration in the land register, including the creation of land charges for financing.
-
Inheritance law
Including Will, contract of inheritance, certificate of inheritance, disclaimer of inheritance
A notarial will or a contract of inheritance settles an estate in a public deed. The notary advises on intestate and testamentary succession, notarises testamentary dispositions and records applications for certificates of inheritance and disclaimers.
-
Company law
Including GmbH formation, amendment of articles, share transfer, commercial register
The formation of a GmbH, amendments to articles of association and transfers of shares are notarised. Filings with the commercial register are certified and submitted electronically.
-
Personal provision
Including Lasting power of attorney, care directive, living will
A lasting power of attorney determines who may act when you can no longer decide for yourself. The notary notarises powers of attorney, care directives and living wills and registers them with the Central Register of Lasting Powers of Attorney on request.
Beyond these fields, the work of the notary includes marriage contracts and other family law matters as well as the law of associations.
An appointment can be requested for a matter from any of these fields.
Procedure
The way to the deed
From the first message to execution, a notarisation follows a fixed procedure ordered by law.
-
Contact
You describe your matter by telephone, by email or through the form on this page. The office clarifies which details and documents are needed and arranges an appointment.
-
Draft
The notary prepares the draft of the deed. The parties receive it in advance for review; for real estate contracts with consumers the law generally provides a period of two weeks for this.
-
Notarisation
At the appointment the notary reads the deed aloud, explains its legal consequences and answers questions. Only then is it signed.
-
Execution
The notary obtains any required approvals, arranges the entries in the land register or the commercial register and informs the parties when the matter is concluded.

Questions
Frequent questions
What parties most often want to know before an appointment.
Certain legal transactions are valid only with notarisation: among others the purchase and transfer of real property, the formation of a GmbH, contracts of inheritance and marriage contracts. In other cases the notarial form is voluntary; a public deed carries particular evidential weight.
The fees are laid down in the Court and Notary Fees Act (GNotKG). They depend on the value of the transaction and are the same at every notary in Germany. On request the office states the fees arising for a given transaction.
By telephone during telephone hours, by email or through the form on this page. Appointments are possible by arrangement outside general office hours as well.
A valid identity document, in many cases the German tax identification number, and the documents the office names when the appointment is arranged: for instance a land register extract, articles of association or existing directives.
No. The notary is bound by law to impartiality and attends to all parties of a transaction equally. One-sided representation of interests is the task of lawyers.
Notarisations take place in German. Anyone who does not have sufficient command of the language may involve an interpreter; the Notarisation Act expressly provides for this procedure. Please mention it when the appointment is arranged.
